Form 2848 vs Form 8821: EA representation mechanics
Form 2848 authorizes an eligible individual to represent a taxpayer for specified tax matters and periods. Form 8821 permits inspection or receipt of tax information but does not grant advocacy authority. Neither a CAF number nor being the return preparer replaces the required authority, and a power of attorney does not automatically permit signing every tax return.
| Situation | Correct response | Exam trap |
|---|---|---|
| Represent the taxpayer before the IRS | Form 2848 for an eligible representative. | Form 8821 alone is not a power of attorney. |
| Inspect or receive tax information | Form 8821 can designate an individual or organization. | Information access does not grant advocacy. |
| Specify covered matters | Identify the tax, form and periods as required. | Using an unrestricted “all years” authorization. |
| Sign a tax return for the taxpayer | Check the narrow signing rules and express authorization. | Assuming a standard POA always permits signing. |

Build the authorization around the actual matter
Check the taxpayer’s identity, the representative’s eligibility, the covered tax matters and periods, signatures, and any additional or excluded acts. A new Form 2848 generally revokes prior authority for the same matters unless the retention procedure is followed. Withdrawal and revocation also need the prescribed steps.
Identify the taxpayer, matters and periods precisely
The scope of Form 2848 is built around the taxpayer on line 1 and the matters, forms and years or periods on line 3. Do not assume that authority for an individual income-tax return also covers a separate business entity’s payroll return or a personal trust fund recovery penalty. The instructions explain how civil penalties and other matters should be identified. A broad personal relationship with the client is not a substitute for specifying the correct scope.
Joint-return matters also require care: spouses execute their own separate Forms 2848. A corporation’s authorization depends on an authorized signer for the entity; an owner’s individual authorization is not interchangeable with the corporation’s. In a partnership case under the centralized audit regime, Form 2848 does not itself designate the partnership representative. Read which person, entity and capacity the question names before deciding that the authorization is complete.
| Existing authority | New request | What needs checking |
|---|---|---|
| An individual’s Form 1040 for one year. | Represent a different tax year. | Whether that year is expressly covered. |
| A shareholder’s personal tax matters. | Act for the corporation on payroll taxes. | Separate taxpayer, signer, matter and periods. |
| Form 8821 information access. | Negotiate the taxpayer’s position. | A qualifying representation authorization. |
| One spouse’s Form 2848. | Represent both spouses on a joint return. | A separate authorization and conflict assessment for each. |

A power of attorney is not permission for every act
Review additional acts, exclusions and signature requirements. Form 2848 does not automatically authorize a representative to sign an income-tax return in every circumstance. The instructions identify the conditions and specific authorization needed for that act. A power of attorney also cannot remove Circular 230’s restriction on negotiating a client’s government refund check. Distinguish a permission the form can grant from conduct another rule prohibits.
A Centralized Authorization File (CAF) number identifies the representative in the IRS authorization system; it is not a professional license and does not establish the scope of a particular engagement. Some specific-use authorizations are not recorded on the CAF. If a representative cannot access a matter, investigate the taxpayer, scope, signatures and processing status rather than assuming a CAF number creates universal access.
Original worked example
The agent can see a transcript but cannot advocate
A taxpayer signed Form 8821 for an EA to obtain account information. The EA is then asked to negotiate the taxpayer’s examination issue.
- 1Recognize that the existing authorization covers information access.
- 2Confirm eligibility to represent and obtain appropriate representation authority.
- 3Specify the relevant matter and periods before acting within that authority.
Form 8821 does not become a power of attorney because the designee holds the EA qualification.
Questions about this topic
Is a CAF number a practice license?
No. It identifies an authorization record in the IRS system; it does not establish eligibility to practice or supply a client’s authorization.
